Terms of Service

1. Services

Ember (“we,” “us,” “our”) provides done-for-you restaurant website design, development, hosting, and maintenance services. By using our website or engaging our services, you agree to these terms.

2. Subscription Plans

• Artisan — $349/month. Includes custom website design, digital menu engine, SEO, booking integration, lead capture, and up to 4 content updates per month.
• Grand Reserve — $649/month. Includes everything in Artisan plus multi-page editorial site, events portal, online ordering integration, unlimited content updates, and dedicated concierge support.

No setup fees. Prices are subject to change with 30 days’ notice.

3. Payment Terms

Subscriptions are billed monthly in advance. Payment is due upon invoice. We reserve the right to suspend services for accounts more than 15 days past due.

4. Cancellation

You may cancel your subscription at any time with 30 days’ written notice. Upon cancellation:

• Your website will remain live through the end of your paid period.
• We will provide an export of your content (text, images, menus) upon request.
• Custom code and design assets built by Ember remain our intellectual property unless otherwise agreed in writing.

5. Your Responsibilities

You agree to:

• Provide accurate restaurant information, menus, and imagery (or allow us to source them).
• Review and approve your website within 7 business days of delivery.
• Not use the website for unlawful purposes.
• Maintain ownership or proper licensing for any content you provide to us.

6. Intellectual Property

All website designs, code, and creative assets produced by Ember are our intellectual property, licensed to you for the duration of your active subscription. Your brand assets (logos, photos, menu content) remain yours.

7. The Ember Collective

Collective members earn referral commissions as outlined on our Collective page. Commission rates ($200 upfront for Artisan referrals, $500 for Grand Reserve referrals, 20% monthly recurring) may be modified with 30 days’ notice. Payouts require a valid payment method on file and are processed monthly.

8. Limitation of Liability

To the maximum extent permitted by law, Ember shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Warranty Disclaimer

Our services are provided “as is” and “as available.” We make no warranties, express or implied, regarding uptime, performance, or fitness for a particular purpose. We do guarantee a 30-day satisfaction guarantee — if you’re not happy within 30 days of launch, we’ll refund your first month.

10. Governing Law

These terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts located in Fulton County, Georgia.

11. Changes to These Terms

We reserve the right to update these terms at any time. Material changes will be communicated via email to active subscribers. Continued use of our services constitutes acceptance of updated terms.
